Booking and participation requirements
All riders must:
- Be aged 25 or over.
- Hold a full motorcycle licence valid for the motorcycle being ridden.
- Follow the guide’s lawful and reasonable safety instructions at all times.
- Read and sign the Rider Agreement before riding.
- Attend the rider safety briefing before the tour begins.
Please read the Rider Agreement below before making your booking.
Cancellations and rescheduling
If you cannot attend, please contact mark@waypointadventuretours.co.uk as soon as possible.
One change of tour date is permitted per booking, provided you contact Waypoint Adventure Tours at least 7 days before your scheduled tour start time. Changes are subject to availability and agreement with Waypoint Adventure Tours.
Requests received with less than 7 days’ notice are not guaranteed and will be considered individually. If a change cannot be agreed and you cannot attend, the cancellation terms below apply.
If you cancel rather than reschedule, we may retain payment to cover reasonable losses directly resulting from your cancellation, up to the full booking price. We will take reasonable steps to reduce those losses and account for costs saved or replacement bookings. Any remaining balance will be refunded.
If Waypoint Adventure Tours cancels your tour before it begins, you may choose an available alternative date or a full refund.
Your statutory rights are unaffected.
1. Nature of the activity and acceptance of risk
I understand that this is a guided motorcycle tour involving public roads and, where included in the booked tour, legally accessible unsurfaced routes. Conditions may include uneven ground, loose stones, mud, ruts, water, steep gradients, restricted visibility and changing weather.
Motorcycling involves a risk of falls, collisions, injury and damage, including serious or fatal injury. Protective equipment cannot eliminate those risks. I voluntarily choose to participate with that understanding.
An accident, fall or injury does not, by itself, establish that Waypoint Adventure Tours is responsible. Responsibility depends on the circumstances and applicable law.
Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence, or any other liability or consumer right that cannot lawfully be excluded or limited.
2. Rider competence and control
I confirm that I hold the licence required for the motorcycle I will ride and meet the eligibility requirements disclosed for this tour. I will give accurate information about my riding experience and relevant limitations.
I am responsible for operating my motorcycle safely, observing traffic laws and riding within my ability and the conditions. I will not ride under the influence of alcohol, drugs or medication that impairs safe riding.
I will tell the guide immediately if I feel unable to continue safely, become excessively tired or consider a section beyond my ability.
I will stop in a safe place and request assistance rather than attempt something I cannot safely manage.
3. Role of the guide and safety instructions
This is a guided tour, not a formal riding instruction course. The guide coordinates the route and group and may provide safety briefings and practical advice.
I must make my own observations and decisions about speed, positioning, obstacles and other road users. I must not assume that another rider’s line or speed is safe for me.
I will follow lawful and reasonable safety instructions. I will not overtake the guide unless directed, race other participants or attempt to catch the group by riding beyond my ability.
I may decline to ride a section and ask the guide to discuss a safe alternative or arrangements to stop participating.
4. Group riding and route restrictions
I will maintain a safe following distance appropriate to speed, visibility, weather and surface conditions.
On sealed roads, I will allow at least the Highway Code’s recommended gap and increase it when conditions require. On trails, I will leave sufficient room for sudden stops, falls, dust and flying debris.
I will follow the formation and regrouping instructions given at the briefing. If separated, I will stop or regroup as instructed when safe. I will not make an unsafe stop or manoeuvre to maintain visual contact.
I will use only routes lawfully open to motorcycles and comply with signs, restrictions and the guide’s directions.
I will not leave the agreed route without discussing it with the guide, except where immediately necessary for safety.
5. Motorcycle handover and care
For a Waypoint motorcycle, I will take part in the pre-ride inspection and identify any existing damage or apparent defect before accepting the bike. Existing damage will be recorded.
I will use the motorcycle responsibly and report any fall, collision, warning light, unusual noise, damage or suspected fault promptly.
I will not continue riding where doing so could make the motorcycle unsafe or increase damage.
If the motorcycle stalls or falls in water and water ingress is suspected, I will not attempt to restart it until the guide has assessed the situation.
I will not allow an unauthorised person to ride the motorcycle. I will follow the security instructions provided and take reasonable care of the motorcycle and keys during stops.
6. Fleet motorcycle damage charges
This section applies only to motorcycles supplied by Waypoint Adventure Tours.
Normal wear and included minor damage
Ordinary accidental drops resulting only in minor cosmetic scuffs or surface scratches are accepted and will not be charged. A drop causing more substantial damage is dealt with under the provisions below.
Minor accidental breakages to levers, foot pegs, gear selectors and mirrors, and punctures, are also included.
Trailside repairs will be attempted where safe and practicable, but immediate repair or continuation of the tour cannot be guaranteed.
Other accidental damage
For other accidental damage caused by me while riding or handling the motorcycle, I agree to pay the reasonable, evidenced repair costs described below.
The combined total for ordinary accidental motorcycle damage and borrowed protective equipment damage arising from the same incident will not exceed £250, as explained in section 8.
This cap applies whether or not an insurance claim is made.
Several damaged parts or items arising from the same accident count as one incident. Separate accidents may give rise to separate charges.
Repair costs
Replacement parts will be charged at Waypoint’s actual dealer trade cost, including delivery and VAT only where incurred and not recoverable.
No workshop labour or administrative fee will be charged for ordinary accidental motorcycle damage.
Charges will allow for the previous condition of the damaged items and will not fund unrelated repairs or improvements.
What I am not responsible for
I will not be charged for pre-existing damage, normal wear, an inherent mechanical fault, inadequate maintenance, or loss attributable to Waypoint’s negligence.
A mechanical failure is not automatically rider-caused damage.
Exceptions for deliberate damage or serious misuse
The free-damage allowances and £250 cap do not apply to motorcycle damage caused by any of the following:
- Deliberate damage or deliberate abuse of the motorcycle.
- Intentional wheelies, burnouts, racing or stunt riding.
- Riding while impaired by alcohol or drugs.
- Knowingly allowing an unauthorised person to ride.
- Knowingly entering a prohibited route or water crossing contrary to an explicit safety instruction.
- Knowingly continuing to ride, or attempting a restart after suspected water ingress, contrary to an explicit instruction to stop.
For these exceptions, I may be charged reasonable, evidenced repair or replacement losses and necessary recovery costs directly caused by that conduct. These losses may exceed £250.
An ordinary riding mistake or accidental fall does not, by itself, trigger an exception.
Waypoint will explain the basis and evidence for any exception relied upon.
Charges will not exceed the loss reasonably attributable to me, will take account of the motorcycle’s pre-incident value where relevant, and will not duplicate amounts recovered from insurance or another party.
7. Protective equipment and loan equipment damage
Equipment requirements and availability
I am responsible for bringing a correctly fitting motorcycle helmet, protective motorcycle jacket, trousers, gloves and motorcycle boots suitable for the booked tour, unless Waypoint Adventure Tours has specifically confirmed in writing that particular items will be supplied.
Customers wishing to borrow equipment must contact Waypoint Adventure Tours before booking to discuss their requirements.
Equipment provision is not guaranteed. A booking or equipment request does not reserve loan kit unless Waypoint has expressly confirmed the items and sizes available.
Any agreed loan equipment is subject to a satisfactory fit check before riding. Waypoint will take reasonable care that supplied equipment is suitable and maintained.
All equipment must be in serviceable condition. I will disclose known damage or significant impacts that may affect its protection and raise any fit or condition concerns before riding.
Participation may be refused if suitable, correctly fitting protective equipment is unavailable.
Protective equipment is designed to reduce the risk or severity of certain injuries but cannot eliminate injury risk.
Care and reporting damage
I will take reasonable care of any helmet, jacket, trousers, gloves, boots or other protective equipment supplied by Waypoint Adventure Tours.
I will report any equipment drop, impact or damage immediately. Equipment whose safety is in doubt will be removed from use pending assessment.
The need for repair or replacement will be assessed in accordance with the manufacturer’s guidance and, where appropriate, advice from the manufacturer or a competent specialist.
A helmet may require replacement after an impact even where damage is not visible.
Accepted wear and tear
Normal wear and tear, ordinary cleaning, small scuffs and reasonable cosmetic marks that do not affect protective performance are accepted and will not be charged.
Chargeable damage
I accept responsibility for damage I cause to borrowed equipment, including accidental damage during a fall, where safe repair or replacement is reasonably necessary.
This includes holes, tears, damaged fastenings and helmet impacts that compromise protective performance or require replacement under the manufacturer’s guidance.
I will not be charged for pre-existing damage, normal deterioration, equipment defects or damage attributable to Waypoint Adventure Tours’ negligence.
How equipment charges are calculated
Where equipment can be safely repaired in accordance with the manufacturer’s guidance, the charge will be the reasonable actual repair cost.
Where replacement is necessary, the charge will be based on Waypoint’s actual trade cost of an equivalent item, including delivery and VAT only where incurred and not recoverable.
A reasonable allowance will be made for the damaged item’s age and previous condition. No retail markup or administrative fee will be added.
Equipment charges for ordinary accidental damage are included within the combined £250 per-incident limit explained in section 8.
Nothing in this section excludes or limits Waypoint Adventure Tours’ legal responsibilities.
8. Security hold and damage assessment
The £250 security hold
If using a Waypoint fleet motorcycle or borrowed protective equipment, I agree to present a suitable credit or debit card at morning sign-on for a £250 pre-authorised security hold.
The hold temporarily reserves £250 against my available balance or credit limit. It is security, not an automatic charge.
The same £250 security hold may be used towards valid charges for motorcycle damage under section 6 and damage to borrowed protective equipment under section 7.
Only one £250 hold is required where I use both a fleet motorcycle and borrowed equipment.
Combined accidental-damage limit
For ordinary accidental damage, the combined total charged for motorcycle and borrowed equipment damage arising from the same incident will not exceed £250.
This is one combined limit, not a separate £250 charge for the motorcycle and another £250 charge for equipment.
Separate incidents may give rise to separate charges. The exceptions for deliberate damage or serious misuse in section 6 remain applicable to motorcycle damage caused by that conduct.
The security hold does not increase the amount I owe or automatically settle any charge. Where valid charges exceed the available hold because of separate incidents or a specified exception, the balance will be invoiced separately.
Inspection and evidence
Where practicable, the motorcycle and borrowed equipment will be inspected with me before and after the ride, and existing damage recorded.
Before taking payment for damage, Waypoint will provide photographs or other supporting evidence, an itemised explanation of the proposed charge and the reason any repair or replacement is necessary.
Payment and release of the hold
I will have a reasonable opportunity to query or dispute a proposed charge before payment is taken.
Subject to that process, I authorise Waypoint to capture valid damage charges from the £250 pre-authorised hold, in accordance with applicable payment-provider rules.
A disputed amount is not treated as agreed merely because a security hold exists. No loss will be recovered twice through customer payment, insurance or another party.
Waypoint will request release of the unused hold promptly after inspection and resolution of any proposed deduction, subject to the payment provider’s authorisation time limits.
The card provider controls when released funds become available.
Nothing in this section excludes or limits Waypoint Adventure Tours’ liability where it cannot lawfully be excluded or limited.
9. Health, fitness and communication
I am not aware of any condition or impairment that makes my participation unsafe.
I will confidentially disclose information relevant to safe participation, including relevant effects of medication, and tell the guide if my condition changes.
I do not need to disclose unrelated medical history. Where I am uncertain about my fitness to ride, I will obtain appropriate medical advice before participating.
I will stop safely and tell the guide if I become unwell, injured or unable to concentrate.
I will not operate a phone or adjust electronic devices while moving.
10. Stopping or terminating participation
Waypoint may pause or end my participation where reasonably necessary for safety, including unsafe riding, impairment, deliberate misuse or failure to follow reasonable safety instructions.
Where practicable, the guide will explain the concern and allow an opportunity to correct it. Immediate termination may be necessary where the risk is serious.
If my serious or repeated breach causes termination, any refund will reflect the services already provided and reasonable losses caused by that breach.
There is no automatic forfeiture of the entire payment regardless of circumstances. Statutory rights remain unaffected.
Stopping the ride does not cancel any valid damage liability under this agreement.
Safe arrangements for ending participation will be discussed with the guide.
11. Customers using their own motorcycles
I confirm that my motorcycle is roadworthy, suitable for the planned tour and legally compliant, including tax, an MOT where required and insurance covering my participation.
I am responsible for maintaining my motorcycle and arranging any breakdown or recovery cover I require.
Waypoint does not insure my motorcycle against damage or guarantee roadside repair or recovery.
This does not exclude responsibility for loss caused by Waypoint’s negligence or breach of its obligations.
If I borrow protective equipment from Waypoint, sections 7 and 8 apply to that equipment even though I am riding my own motorcycle.
12. Independent stops
Food, accommodation and other services purchased directly from independent businesses are supplied under those businesses’ terms.
Complaints about those services should normally be directed to the provider.
This does not exclude Waypoint’s responsibility for its own acts, omissions or services.
